The petitioner with a grievance that the second respondent police is harassing him under the guise of an enquiry, has approached this Court.
2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents 1 & 2 submits that the petitioner's wife has lodged a complaint as against this petitioner, based on which, they are conducting a petition enquiry. In fact, they have not harassed the petitioner.
3.It appears that there is a matrimonial dispute between the petitioner and his wife. His wife has lodged a complaint as against the petitioner, based on which, the respondent police are conducting petition enquiry. The petitioner claims that the respondent police is harassing him under the guise of an enquiry.

4.Since it is a matrimonial dispute, the respondent police shall refer the matter to the Social Welfare Officer and the Social Welfare Officer shall take a call on this issue and submit a report to the respondent police. In the event, if the complaint of the petitioner's wife constitutes any offence, the respondent police shall take necessary action, in accordance with law. The petitioner has to co-operate for the enquiry. In the meantime, the respondent police shall not harass the petitioner.
5.With the above directions, this Criminal Original Petition is disposed of.
