PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings of the 2nd respondent SRC in withdrawing the recognition of petitioner's college for conducting B.Ed., programme of two years duration with an annual intake of 100 students (2 basic units) w.e.f., 2022-2023 onwards in F.SRO/NCTE/APS07607/B.Ed/ (TN)/2021/29350, dated 01.12.2021 and consequential impugned orders of the 1st respondent NCTE in APPLSRC 202214261, dated 21.12.2022 in rejecting the appeal and quash the same and further, to direct the respondents 1 and 2 to restore the recognition for the B.Ed., (2 basic unit) programme conducted in the petitioner's college w.e.f., 2024-2025 academic session onwards. ORDER
Challenge has been made to the order of the 2nd respondent, dated 01.12.2021, withdrawing the recognition of the petitioner's college for conducting B.Ed., programme of two years duration with an annual intake of 100 students (2 basic units) w.e.f., 2022-2023 onwards. 2/5
2.Though the said order of the 2nd respondent is challenged on the ground that no opportunity has been given, the learned counsel appearing for the petitioner would submit that as the period of 2022-2023 is already over, in respect of the period of 2024-2025, the petitioner College wants to make a fresh representation for recognition, after complying with all the requirements. Therefore, it would suffice, if the authorities concerned are directed to consider the representation to be made by the petitioner on its own merits. 3.
In such view of the matter, the petitioner is directed to give a fresh representation after complying with all the requirements to the 2nd respondent, who in turn, on receipt of such representation, shall consider the same and pass appropriate orders on merits and in accordance with law within a period of two months from the date of receipt of a copy of the application. 4.With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 18.10.
