PRAYER : Criminal Original Petition filed under Section 528 of B.N.S.S., to direct the first respondent to transfer the investigation in Crime No.118 of 2024, dated 06.03.2024 on the file of the third respondent and entrusted the same to the fourth respondent for further investigation or any other competent officer and file a final report before the jurisdictional Magistrate within the time stipulated by this Court. ORDER
This Criminal Original Petition has been filed, invoking Section 528 of B.N.S.S., seeking orders, to direct the first respondent to transfer the investigation in Crime No.118 of 2024, dated 06.03.2024 on the file of the third respondent and entrusted the same to the fourth respondent for further investigation or any other competent officer and file a final report before the jurisdictional Magistrate within the time stipulated by this Court.
2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents 2/4
would submit that on the basis of the complaint given by the complainant, FIR came to be registered in Crime No.118 of 2024 for the offence under Section 174 Cr.P.C.,that they have already examined all the witnesses and they are awaiting for opinion with regard to the postmortem and seeks two months time to file final report before the jurisdictional Magistrate Court.
3. Recording the submission made by the learned Government Advocate (Criminal Side), the third respondent is directed to proceed with the investigation and file final report in Crime No.118 of 2024 before the jurisdictional Magistrate Court, within a period of two months from the date of receipt of a copy of this order. The second respondent is directed to monitor the investigation.
4. With the above direction, this Criminal Original Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. 21.08.2024 NCC : Yes/ No Index :Yes/No Internet : Yes/ No das 3/4
