PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents No.1 and 2 to provide adequate police protection while surveying the properties compromised in Survey No.89/2A2B, 89/2A2A and 89/2A1 measuring to an extent of 4 acres and 82 cents at Keelasitharkadu Village, Kadakadapai Panchayath, Thanjavur District, by considering the petitioner's representation dated 26.06.2025 by giving notice to the parties concerned, within a stipulated time.

O R D E R

Seeking police protection for survey of his properties in Survey Nos.89/2A2B, 89/2A2A and 89/2A1, at Keelasitharkadu Village, Kadakadapai Panchayat, Thanjavur, the petitioner has approached this Court.

2.The learned counsel for the petitioner by referring to the case in Crime No.386 of 2025 registered as against the fifth 2/6

respondent submits that apprehending that the fifth respondent would create some problem and prevent this petitioner from surveying his lands, the petitioner has filed this petition, seeking police protection. He further submits that the petitioner has paid the requisite fee for survey on 26.06.2025.

3.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 1 & 2. Mr.F.Deepak, learned Special Government Pleader takes notice for the respondents 3 & 4.

4.The learned Additional Public Prosecutor submits that the applications for survey of lands would be considered on seniority-wise and whenever there is a request from the survey officials, seeking police protection for conducting the survey of the petitioner's land, they are prepared to provide police protection. 3/6

5.This Court considered the submissions made by the learned counsel for the petitioner as well as the learned Additional Public Prosecutor.

6.Apprehending that one Raja/the fifth respondent herein would prevent this petitioner from surveying his property, the petitioner has approached this Court, seeking police protection. The petitioner also claims that he has paid the requisite fee for survey of his property. On the side of the respondent police, it is stated that whenever, a request has been received from the survey officials seeking police protection for conducting the survey of the petitioner's land, they are prepared to provide police protection. They have also stated that the surveys would be conducted on seniority-wise. It is the responsibility of the Revenue officials to ascertain whether there is any problem and in the event, if they found any problem, they can very well ask for police protection from the respondent police and on such request, the respondent police would provide necessary police protection.

7.With the above observations, this writ petition is closed. No costs.
