PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records relating to the show cause notice issued under Section 5 of Act 3 of Tamil Nadu 1905 on 09.09.2014 on the file of the third respondent, quash the same.

[Order of the Court was made by The Hon'ble CHIEF JUSTICE] Without going into the details, following order is passed: a) Second respondent shall consider the representation dated 12.09.2014, together with a further representation dated 29.09.2014 and any response to the notice dated 09.09.2014, issued under Section 7 of Tamil Nadu Land Encroachment Act, 1905 and pass a reasoned order dealing with all submissions of petitioner;

b) Before passing an order, personal hearing be given, notice whereof shall be communicated atleast 3 working days in advance. Thereafter, second respondent may take further steps in accordance with law. 2.We clarify we have not expressed any view or opinion on the merits of the matter.
