Prayer: Writ Petition filed under Article 226 of Constitution of India, for issuance of a Writ of Declaration for directing the 2nd respondent to cancel the fraudulent settlement deed vide No.2908/2019 dated 31.11.2019 registered at 3rd respondent Sub Registrar Office and subsequent fraudulent settlement deed vide document no:173/2025 dated 25.01.2025 registered at 4th respondent sub registrar office in respect of land measuring 6.50 ares comprised in survey No.400/20 situated at Seevanallur Village, Elathur, Shengottai Taluk, Tenkasi District, on the basis of my representation dated 02.07.2025.

ORDER

The writ petition is filed seeking a direction to the 2nd respondent to cancel the settlement deed dated 31.11.2019 and 25.01.2025, considering the petitioner's representation dated 02.07.2025.

2. According to the petitioner, the subject property in S.No.400/20 with an extent of 6.50 ares situated at Seevanallur Village, Elathur, Shengottai Taluk, Tenkasi District originally belonged to his grandfather. The patta for the subject property also mutated in the name of his 2/6

grandfather. Apart from the subject property, the petitioner's grandfather owned several properties. After his death, his sons namely Madasami, Subbiah, Velu and Arumugam were in possession and enjoyment of the properties. The subject property in S.No.400/20, was allotted to the petitioner's father and his brother namely Velu. The respondents 5 and 6 based on the fabricated/fraudulent document executed a settlement deeds dated 31.11.2019 and 25.01.2025 and registered the same. When it came to the knowledge, the petitioner submitted a representation before the respondent on 02.07.2025, seeking cancellation of the above settlement deeds dated 31.11.2019 and 25.01.2025. However, no action has been taken to date. Hence, the petitioner has come before this Court.

3. The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that the representation of the petitioner dated 02.07.2025 will be considered in accordance with law within the time stipulated by this Court.

4. In view of the same, without expressing any opinion on the merits of the matter the respondents 1 to 4 are directed to consider the representation of the petitioner dated 02.07.2025 and pass final order on its 3/6

own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and other interested parties.

5. The writ petition is disposed of with the above observations. No costs.
