PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st Respondent to expedite and complete the proceedings in Second Appeal vide file No.CIC/IOVBK/A/2025/610751 and provide all the information what is sought in petitioner Right to Information Act Application within the stipulated time as fixed by this Court.

O R D E R

The writ petition is filed seeking a direction to the first respondent to expedite the proceedings in second appeal vide file No. CIC/IOVBK/A/2025/610751 pending on his file.

2.Mr. S.S.Sundarapandian, learned Central Government Standing Counsel takes notice for the first respondents. Mr.N.Dilip Kumar, learned Counsel takes notice for the respondents 2 to 4. By consent of 2/5

both parties, the writ petition is taken up for final disposal at the admission stage itself.

3.It is the case of the petitioner that he sought for certain information from the third respondent with regard to his Bank account maintained with the fourth respondent. Being unsatisfied with the reply received from the third respondent, the petitioner filed a first appeal before the second respondent and the same was dismissed. Aggrieved by the same, the petitioner preferred a second appeal before the first respondent on 04.03.2025 and the same was taken on file in S.A.No. CIC/IOVBK/A/2025/610751. Even though the petitioner filed the second appeal as early as in the month of March 2025, till date the same has not been considered. Hence the petitioner has come before this Court.

4.The learned Counsel for the first respondent would submit that number of second appeals are pending on the file of the first respondent. Therefore, the second appeal filed by the petitioner will be considered in accordance with the law as per the seniority. 3/5

5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the second appeal filed by the petitioner in file No. CIC/IOVBK/A/2025/610751 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner, third and fourth respondents.

6.With the above direction, this writ petition stands disposed of. No costs.
