ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2 in Crime No.28 of 2011 apprehends arrest at the hands of the respondent police for the offences under Sections 467, 468, 420, 506(i) r/w 34 IPC and seeks anticipatory bail.
2. According to the prosecution, the accused have fabricated documents and sold the property of the defacto complainant in Survey Nos.81/7, 86/1 and 86/3 in Manthoppu village at Kariyapatti Taluk, Virudhunagar District.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated only on suspicion. It is further submitted that the case was registered in 2011 and the entire investigation is over.
4. The learned Government Advocate (crl. Side) submitted that the accused Nos.4 and 5 were already arrested and released on bail and the accused Nos.1 to 3 absconded.
5. Considering the facts and circumstances of the case, this Court https://hcservices.ecourts.gov.in/hcservices/ is inclined to grant bail to the petitioner with certain conditions.
Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Virudhunagar and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. for a period of two weeks and thereafter, as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
