ORDER

The writ petition is filed seeking a direction to the 1st respondent to cancel the patta issued in favour of the 3rd respondent in respect of the property situated in Old Survey No.31/2, New Survey No.31/7, Sengattanpatti Village.

2. Heard the learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate who takes notice for the respondents 1 and 2. Since no adverse orders are to be passed against the respondents 3 and 4, notice to them are dispense with.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself. 2/6

4. According to the petitioner, the 3rd respondent herein sold the property situated in S.No.31/5 in favour of the petitioner's mother and sister. Later the 3rd respondent obtained assignment of property situated in S.No.31/2 and 31/7, which are poramboke land used as access to reach the land purchased by the petitioner by making a representation that she was landless poor.

According to the petitioner, the 3rd respondent sold the property to the petitioner and after receiving consideration, made a false representation before the officials as if she was landless poor and obtained assignment. Therefore, the petitioner submitted a representation on 20.06.2020, before the 1st respondent seeking cancellation of the assignment issued in favour of the 3rd respondent in respect of the property situated in S.No.31/2 and 31/7. The same has not been considered. Hence, the petitioner is before this Court.

6. Mr.M.Gangatharan, learned Government Advocate who takes notice for the respondents 1 and 2 would submit that the representation submitted by the petitioner will be dealt with in accordance with law.

7. In view of the same, the petitioner is directed to submit a fresh representation before the 1st respondent within a period of two (2) weeks from today. On receipt of such representation, the 1st respondent is directed to consider and pass final orders on its own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, private respondents 2 and 4.
