Prayer:- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, to direct the second respondent to survey and demarcate the property comprised in Old Survey No.206A/1, (Town Survey Block No.36, T.S.No.9/3, 0-39-61.5 Ares) situated at Vadukapatti Village, Usilampatti Taluk, Madurai District and consequently direct the fifth respondent to provide adequate police protection at the time of Surveying and Fencing the petitioner's property based on the petitioner's representation dated 23.06.2025 within the time frame that may be stipulated by this Court. ORDER
The petitioner herein seeks a direction to the second respondent to survey the property situated in Old Survey No.206A/1, (Town Survey
Block No.36, T.S.No.9/3, 0-39-61.5 Ares) in Vadukapatti Village, Usilampatti Taluk, Madurai District, by considering his representation dated 23.06.2025.
2.Heard the arguments of M/s.P.Kalaiyarasi, learned counsel appearing for the petitioner, Mr.A.Baskaran, learned Additional Government Pleader appearing for the respondents 1 to 4 and Mr.M.Vaikkam Karunanithi, learned Government Advocate appearing for the fifth respondent.
3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4. According to the petitioner, the subject property is her ancestral property and after death of her father, the petitioner and her mother alone are the legal heirs and the property has been in her possession. The Town Survey Land Register for the subject property stands in the names of the petitioner's father, Selvam and five others. The petitioner submitted an online application on 19.06.2025 seeking survey of the property. The
same has not been considered. Hence, the petitioner has come before this Court.
5.The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that application of the petitioner will be considered in accordance with law.
6. In view of the same, without expressing any opinion on the merits of the matter, the respondents 2 and 3 are directed to consider the online application of the petitioner dated 19.06.2025 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, other pattadars as per the TSLR, other legal heirs of the petitioner's father, Selvam, neighbouring land owners and other interested parties.
