ORDER
The petitioner is the mother of the defacto complainant in Cr.No. 667 of 2021. She has approached this Court seeking a direction to the first respondent Police to complete the investigation in Cr.No.667 of 2021 and file the final report, within a time frame. 2.The learned Government Advocate(Crl.side) appearing for the first respondent submits that the investigation in Cr.No.667 of 2021 has been completed and final report has also been filed through E.Filing before the learned Judicial Magistrate No.II, Pathmanapapuram, on 30.04.2025.
3.It appears that the respondent Police has filed final report through E.Filing on 30.04.2025 and the same has not been taken on file for the past three months. There is no justification for the trial Court to keep the final report pending without taking it on file. It is not known whether final report filed in a proper manner. Mere filing of final report is not sufficient. It is the duty of the respondent Police to ensure that the final report is taken on file, without further delay. The trial Courts are 2/4
also having certain responsibilities to take up the final reports, within a reasonable time. This delay by the trial Court is also not appreciable. Expecting that the final report would be taken up on file, this criminal original petition is closed.
