ORDER : The Court made the following order :- The petitioner / A6, who was arrested and remanded to judicial custody on 09.09.2023 for the offences punishable under Sections 8(c), 20(b)(ii)(c) and 25 of NDPS Act and Section 201 of IPC in Crime No.136 of 2023 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 215kgs ganja . Hence the case.

The learned counsel for the petitioner would submit that the respondent police has registered a false case against the petitioner and he has not committed any offence as alleged by the prosecution. The petitioner is in custody on 09.09.2023. The petitioner is the driver and he did not know what was the parcel available in the packed bundle and the owner//A7 only engaged the petitioner as a temporary driver for daily wages. A1 alone loaded the packed bundle in the vehicle and no previous case is pending against the petitioner. Hence, he prays to grant bail to the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner actively participated in the crime and he is the driver of the car in which the contraband was transported and the petitioner only handed over the contraband from the vehicle and he was caught red handed along with other accused. Further several petitions filed by the petitioner for dismissed by this Court and there is no change in circumstances of the case to consider the present petition and no ground available to satisfy the condition under Section 37 of the NDPS Act . Further the contraband involved in this case is a commercial quantity and now the case is posted for examination of witnesses and thereby he seeks dismissal of the petition.
5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side and also considering the fact that the quantity involved in this case is commercial quantity and the petitioner is none other than the driver of the vehicle in which the contraband was transported and now the trial has been commenced at this stage it is not appropriate to allow this petition. 3/5
7. Hence the petition stands dismissed.
