The Writ Petition is directed against the order dated 07.08.2021 passed by the second respondent.
2. In this matter, this Court has earlier observed that though the case was consistently listed on 10.11.2021, 06.12.2021, 20.01.2022 and 28.01.2022 and lastly on 02.02.2022 and that there was no representation for the writ petitioner.
3. When the matter was taken up for hearing on 29.04.2024, at the request of the learned counsel appearing for the writ petitioner, the matter was adjourned to 10.06.2024 finally and on 10.06.2024, it was again adjourned to 24.06.2024 and then on 24.06.2024, Mr.M.Mahaboob Athiff, learned counsel representing for the writ petitioner would submit that the counsel already on record Mr.G.Jeremiah has requested him to argue the matter and he sought two days time and hence, the matter is posted today (26.06.2024). When the matter is taken up for hearing today in the morning, Mr.M.Mahaboob Athiff, learned counsel representing for the writ petitioner would submit that the writ petitioner has contacted 3/6
him and directed him not to argue the matter and hence, he was reporting no instruction and hence, the matter has been passed over and subsequently when the matter is taken up for hearing, Mr.Kathiravan, learned counsel would submit that they are going to file a change of vakalat for the writ petitioner and sought time and this Court directed the counsel to file change of vakalat today itself and argue the matter, but he is not ready.
4. Considering the delaying tactics adopted by the writ petitioner, this Court is not inclined to grant any further time. Hence, this Writ Petition is dismissed for default. Consequently, connected Miscellaneous Petition is closed. No costs.
