Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the 2nd Respondent to give adequate police protection to survey the land and fixed the boundaries in his Patta land in survey No. 202/2 to an extent of 1.63.0 Ares situated in Tholur Village Paramakudi Taluk, Ramanathapuram District.

This petition has been filed to direct the 2nd Respondent to give adequate police protection to survey the land and fixed the boundaries in his Patta land in survey No. 202/2 to an extent of 1.63.0 Ares situated in Tholur Village Paramakudi Taluk, Ramanathapuram District .

The learned counsel appearing for the petitioner would submit that pending civil suit he sought for police protection to survey his land comprised in survey No. 202/2 to an extent of 1.63.0 Ares situated in Tholur Village Paramakudi Taluk, Ramanathapuram District. He further would submit that there is a civil suit is pending between the petitioner and the third respondent.
3. Under these circumstances, the petitioner sought for a direction to revenue officials to survey his land in this regard. But, the Village Administrative Officer replied that there is a https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P(MD).No. 13501 of 2019 civil dispute pending between them and there are objections from the villagers to survey the aforesaid land comprised in survey No. 202/2 to an extent of 1.63.0 Ares situated in Tholur Village Paramakudi Taluk, Ramanathapuram District. He further stated that only after the outcome of the civil proceedings the land will be surveyed.

In view of the above, in such circumstances, police protection cannot be granted to survey the petitioner's land comprised in survey No. 202/2 to an extent of 1.63.0 Ares situated in Tholur Village Paramakudi Taluk, Ramanathapuram District. However, the petitioner can very well approach the concerned jurisdictional police for adequate police protection after the outcome of the civil suit.
5. With the above observations, the Criminal Original Petition stands disposed of.
