ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to forbear the first respondent from in any way registering a deed of conveyance in respect of the land situated in S.No.98/3 and S.No.98/2 in Vadipatti Taluk, Madurai North, Madurai District.

2. Admittedly, suits in O.S.Nos.1070 of 2012 and 558 of 2016 were filed on the file of Principal Sub Court, Madurai, and the same were allowed on 28.02.2025, in favour of the second respondent. Subsequently, the petitioner preferred an appeal in A.S.No.70 of 2025 and the same is pending. Along with the appeal suit, the petitioner has also filed an application seeking interim injunction , which has not been considered till date. In the meanwhile, the petitioner is apprehending that based on the judgment and degree granted in the said suits, the second respondent may encumber the subject property.

3. In view of the above, this second respondent is restrained from encumbering the subject property for a period of three months. In the meantime, the Appellate Court is directed to consider the petitioner's application for injunction and pass appropriate orders, within a period of three (3) months from the date of receipt of a copy of this order.

4. With the above said directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
