For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 932 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 4(1)(a) r/w 4(1)A of Tamil Nadu Prohibition Act in Crime No.932 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the respondent Police was on patrolling duty at Devananchery near old theatre. At that time, one suspect was standing in that place and on search made by the respondent Police, the accused was found in possession of 20 bottles of Pondicherry arrack. Therefore, the present case came to be registered.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4. The learned Government Advocate appearing for the respondent Police opposed for grant of anticipatory bail on the ground that the petitioner is having seven previous cases in (i) Crime No.339 of 2012 of KKM West Police Station (ii) Crime No.496 of 2013 of KKM Taluk Police Station (iii) Crime No.592 of 2015 of Sulur Police Station (iv) Crime Nos.197 of 2018, 303 of 2018, 56 of 2020, 08 of 2021 of Swamimalai Police Station.

5. Considering the nature of allegation levelled against the petitioner and the antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
