O R D E R
The present Writ Petition has been filed to quash the order passed by the fifth respondent, wherein, the request of the petitioner for providing electricity service connection to his residential house has been rejected primarily on the ground of pendency of O.S.No.140 of 2024, on the file of District Munsif Court, Palani.
2.A perusal of the records would reveal that the above said suit has been filed by the sixth respondent herein seeking declaration that the sale deed executed by the second defendant in favour of fourth respondent(Writ Petitioner) is null and void and apart from other prayers, the sixth respondent has also prayed for permanent injunction not to disturb his possesion. 3.The learned counsel for the petitioner submits that no interim order has been granted by the trial Court. Despite notice having been served upon the sixth respondent on 2.8.2025, the sixth respondent has not appeared either in person or through counsel.
4.Considering the fact that as on today, the sale deed stands in the name of the Writ Petitioner, the order impugned herein is 3/6
quashed and the respondents 1 to 5 are directed to provide electricity service connection to the Writ Petitioner. However, providing service connection in the name of he Writ Petitioner will be subject to the judgment to be passed in O.S.No.140 of 2024, on the file of District Munsif Court, Palani. Electricity Service connection in the name of the Writ Petitioner would not affect the rights of the sixth respondent in the civil suit. 5.With the above directions, the Writ Petition is allowed to the extent as indicated above. No costs.
