PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent to disburse the pension, gratuity and other benefits as mentioned in his representation dated 16.04.2014 with 10% interest per annum for the delayed payment of terminal benefits within the time frame as may be fixed by this Court. O R D E R

The learned counsel appearing for the petitioner has received instructions stating that the petitioner has received his entire retirement benefits. But, however, he has not received his pension amount.

2. The learned Standing Counsel appearing for respondent Nos.1 to 3 would submit that since the petitioner is not eligible to receive pension, the pension amount has not been paid to him by the respondents.

3. Since the entire retirement benefits have been disbursed to the petitioner on the petitioner attaining the age of superannuation by the 2/4

respondents and the prayer sought for in this writ petition having been achieved, nothing survives for further adjudication in this writ petition.

4. However, since the learned counsel appearing for the petitioner submits that the petitioner is eligible to receive pension, this Court grants liberty to the petitioner to submit his representation to the respondents seeking for payment of pension within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation, the respondents shall consider the same on merits and in accordance with law within a period of twelve weeks thereafter.
