PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned proceeds respondents in refusal check slip dated 06.08.2024 and to quash the same as illegal and consequently, to direct the respondent to register the sale deed presented by the petitioner, dated 06.08.2024.

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned refusal check slip dated 06.08.2024 and consequently, to direct the respondent to register the sale deed presented by the petitioner dated 06.08.2024. 1/4
2.Through the impugned order, the respondent has refused to register the sale deed stating that DTCP plan approval was not obtained and it is against Section 22-A(2).
3.On perusing the sale deed, it is seen that the petitioner is purchasing 40 cents of land and there is a panchayat road on eastern side. Therefore, new road was not laid and it is the old road only. Further, the petitioner is purchasing the land as agricultural land and not as housing plot. 4.Therefore, the impugned refusal slip is erroneous and total nonapplication of mind. Hence, the impugned order is quashed and the respondent is directed to register the sale deed within a period of 4 weeks from the date of receipt of a copy of this order.
5.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
