Respondents Prayer : Writ Petition is filed under Article 226 of Constitution of India, praying for issuance of a Writ of Mandamus, directing the 4th respondent to take immediate action and to instruct the officials who involved in the surveying the land based on the order dated 16.07.2019 of this Court in W.P.(MD)No.15767 of 2019 to earmark the detailed pathways in the patta lands in S.Nos.301/1A, 1B,1C, 300, 299/1A, 2A, 2B, 298/1, 2D, 4A, 297/2A, 316, 310, 308, 306, 304, 303 around the Karupatti hill rock in S.No.302, Veriyapur Village, Oddanchatram Taluk, Dindigul District.

ORDER

(Order of the Court was made by T.S.SIVAGNANAM, J) Heard Mr.R.Senthil Kumar, learned counsel appearing for the petitioner and Mr.S.Angappan, learned Government Advocate appearing for the respondents 1 to 6.

2.The petitioner is before this Court for the second time for conducting survey. Initially, the Writ Petition in W.P.(MD)No.15767 of 2019, was filed for the purpose of earmarking the boundaries and removing the encroachment in the Government pathway in Survey No.310 and the Government land in Karupatti hill rock comprised in survey No.302 of Veriyapur Village, Oddanchatram Taluk, Dindigul District. The Court has directed the survey to be conducted in survey Nos.302 and 310. Now the petitioner is before this Court once again stating that adjacent lands also have to be surveyed and earmarked as pathway. It goes without saying that when a survey is conducted, it should be comprehensive so that the object of the survey is achieved.

3.The learned counsel for the petitioner submits that the Police protection should also be granted.

4.The learned Government Pleader would submit that the survey is under way and the Police help is also sought for. 5.We direct that survey should be conducted in a comprehensive manner covering all the survey numbers so that in future there is no necessity for re-survey.
