Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records of the respondent provisional results dated 12.09.2014 for appointment by Direct Recruitment to the post of Forest Apprentice in the Tamil Nadu Forest Subordinate Service included in Group - VI services for the years 2006 - 09 and quash the same as consequently direct the respondent to select the petitioner as per her eligibility to the post of Forest Apprentice in the Tamil Nadu Forest Subordinate Service included in Group - VI services for the years 2006 - 09 within the period stipulated by this Court.

O R D E R

The issues raised in the present writ petition had already been adjudicated by the Hon'ble Division Bench in W.A.(MD)Nos.370 to 388, 420 and 421 of 2013 and the judgment was delivered on 14.08.2014. The said factum is stated in the counter filed by the respondents and the relevant paragraph is extracted hereunder:- "9.It is submitted that the educational qualification possessed by the candidate has been announced under item (b) of the qualification, besides the candidate had not enclosed the onus of proof regarding the equivalence of qualification along with her application as per paragraph (9) of Instructions, etc. to Candidates.

Hence, the question of considering her qualification as equivalent to the B.Sc. Forestry does not arise. Further, as Writ Appeal https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No. 16143 of 2014 filed by the Commission were pending before the Hon'ble High Court, and the request of the candidate to publish the results could not be processed at the time of her representation. The candidate was informed of the said fact vide this office memorandum No.5543/OTD-B4/2013 dated 23.09.2013.

10.It is further submitted that with reference to the orders of the Hon'ble High Court of Judicature at Madras dated 14.08.2014 issued in W.A.Nos.370 to 388 of 2013, 420 and 421 of 2013 and connected M.Ps, the selection of candidates for appointment by direct recruitment of candidates against 80 (79+1CF) vacancies to the post of Forest Apprentice, in the Tamil Nadu Forest Subordinate Service included in Group - VI Services, for the years 2006 - 2009 was finalized and the results were published on 12.09.2014. The said candidate had obtained a total of 574.50(W.E-511.50; O.T.63.00)"

2.In view of the fact that the issues raised in the present writ petition are no more res integra, no adjudication is required. Accordingly, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
