PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, to direct the respondent to consider the petitioner's representation dated 28.06.2014 and to take appropriate action by conducting an enquiry on the petitioner's complaint as provided under Section 80 and 81 of the Tamilnadu Cooperative Societies Act and also removing the delinquent James Udayasurian as provided under Section 36 of the said Act and to take appropriate action against him according to law.

O R D E R

This writ petition has been filed to direct the respondent to consider the petitioner's representation dated 28.06.2014 and to take appropriate action by conducting an enquiry on the petitioner's complaint as provided under Section 80 and 81 of Tamilnadu Cooperative Societies Act and also removing the delinquent James Udayasuriyan as provided under Section 36 of the said Act and to take appropriate action against him.

2.When the writ petition was filed, the persons, against whom action was sought to the taken, was not added as a party. Therefore, the petitioner had preferred miscellaneous petition in M.P.(MD).No.1 of 2014 in the instant writ petition, in which notice has been ordered. 3.Mr.James Udayasuriyan, learned counsel entered appearance on behalf of the proposed respondents. But, today, when the matter is taken up for hearing, there is no appearance on behalf of the proposed respondents. 4.Even though the prayer has been sought to direct the 1st respondent to consider the petitioner's representation dated 28.06.2014 and take appropriate action as per the provisions of Section 80 and 81 of the Tamilnadu Cooperative Societies Act, this Court, without going into the averments made in the affidavit filed in support of the writ petition, the 1st respondent is directed to consider the representation of the petitioner dated 28.06.2014 and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

5.With the above direction, this writ petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
