When the matter is taken up for hearing, Mr.Balakrishnan, learned Counsel representing Mr.K.N.Govardhanan, learned Counsel appearing for the first respondent submitted that the order impugned in this Civil Revision Petition is an order for carrying out amendment in the plaint during the pendency of the Appeal Suit in A.S.No.166 of 2008. Since the appeal in A.S.No.166 of 2008 is already disposed of, the learned Counsel appearing for the first respondent submitted that the prayer in this Civil Revision Petition has become infructuous and the Civil Revision Petition may be dismissed as infructuous.
