ORDER

The writ petition is filed seeking a direction to the 1st respondent to dispose of the petitioner's appeal dated 10.09.2020 pending in proceeding No.Oo.Mu.A4/4503/2020.

2. Heard the learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader who takes notice for the respondents 1 and 2.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, he purchased the subject property on 20.11.2006 from one Maimponbeevi. The 2nd respondent by order dated 24.07.2020 effected sub-division and issued patta in the name of the 3rd respondent erroneously.

5. Aggrieved by the same, the petitioner preferred an appeal before the 1st respondent on 10.09.2020 and the same has not been disposed of till date.

The learned counsel appearing for the petitioner would submit that purchaser of the subject property from the 3rd respondent viz., the 4th respondent instituted a suit for declaration and consequential relief in O.S.No.60 of 2020 on the file of District Munsif cum Judicial Magistrate, Alangudi and the same was also dismissed for default on 11.09.2023. However, the 1st respondent has not considered the appeal filed by the petitioner till date. Hence, he has come before this Court with the above mentioned prayer.

7. The learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit that the appeal submitted by the petitioner will be considered in accordance with law. 3/6

In view of the same without expressing any opinion on the merits of the matter, the 1st respondent is directed to consider the appeal filed by the petitioner dated 10.09.2020 and pass final orders on its own merits within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the respondents 3 and 4.

9. The writ petition is disposed of with the above observations. No costs.
