ORDER

This Writ Petition has been filed for issuance of Writ of Mandamus, directing the first respondent to consider the representation made by the petitioner on 10.09.2021, wherein the petitioner has sought for rectification of the entry made in the UDR with respect to the subject property.

2. Heard the learned counsel appearing on behalf of the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.

3. The case of the petitioner is that the subject property belongs to his ancestors and subsequently, the father of the petitioner and his brothers entered into a partition and Survey No.13/1 was allotted in favour of the father of the petitioner. The father of the petitioner died intestate and the property was inherited by the petitioner.

4. The grievance of the petitioner is that the property has been categorized as a Government land and this had taken place during the UDR scheme. The petitioner wanted to get this mistake rectified and hence, made a 2/5

representation on 10.09.2021 to the first respondent. Since the same did not evoke any response, the present Writ Petition has been filed before this Court.

5. The learned Additional Government Pleader appearing on behalf of the respondents produced the written instructions received from the second respondent. It is clear that already an enquiry has been conducted by the second respondent in this regard and the relevant portions in the report are extracted hereunder:- 3/5

Taking into consideration the facts and circumstances of the case and the report of the second respondent, there shall be a direction to the first respondent to deal with the representation, dated 10.09.2021 and pass final orders within a period of six weeks from the date of receipt of a copy of this order.
