Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER:- TO ENLARGE THE PETITIONER ON INTERIM BAIL IN CRIME NO.462 OF 2024 ON THE FILE OF THE RESPONDENT POLICE ORDER : The Court Made the following order :- Today (15.08.2024) the interim bail application is moved as an urgent house motion.
2.The petitioner, who was arrested and remanded to judicial custody in 1/4
connection with Cr.No.462 of 2024, on the file of the respondent Police, from 26.07.2024 for the offences punishable under Sections 8(c), 20(b), (ii)(B) of NDPS Act, seeks interim bail, on the ground that the petitioner's father, Paulraj, had died. 3.The case of the prosecution is that the petitioner and other accused were in illegal possession of 8.150 kgs of Ganja. Hence, the complaint. 4.Heard the learned Counsels on either side and perused the materials available on record.
5.Considering the fact that the petitioner's father, Paulraj, had died in the wee hours of today and considering the arguments of the learned Counsel for the petitioner that the petitioner is the only son to perform the last rites, this Court grants interim bail upto 05.00 pm on 19.08.2024 on the following conditions: (I)The petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) before the Jailer/Superintendent of Prison concerned and he shall be released on his own bond.
(II)Upon release, the petitioner will straight proceed only to his address, namely, No.1/287(1), Hari Baskar Colony, K.Kallikudi, Ramji Nagar, Tiruchirappalli District and shall perform the rites of his late father at home as well as the concerned burial ground/crematorium and will not move around anywhere else, except in connection with ceremonies.

(III)If the petitioner has to move out of Ramji Nagar, he shall not do so without informing the local Inspector of Police, namely, Ramji Nagar Police Station, Tiruchirapalli and also the Investigation Officer in the present case. (IV)The petitioner shall report before the Ramji Nagar Police Station, Tiruchirapalli, twice a day, ie., at 10.30 am and 05.30 pm., and shall return to the Prison well before 05.00 pm on 19.08.2024.
