Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Madamus, directing the respondent herein to issue the passport in Application in File No. MD1066051032523, dated 01.05.2025 and thereby issue the petitioner passport within the time limit that may be stipulated by this Court.

ORDER
This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Central Government Standing Counsel for the respondent.
2. The petitioner has prayed for a mandamus to direct the respondent to issue a duplicate passport to the petitioner, pursuant to an application filed by her on 15.07.2025.
3. The learned counsel for the respondent would submit that the petitioner was a holder of the passport No.E3173358, dated 12.10.2002, which was valid up to 11.10.2012. It is submitted that in the said passport, the petitioner's name was given as Taslim Banu Abdul Rahman, and her date of the birth was given as 23-08-1987. It is submitted that later, the petitioner had applied for a fresh passport, which was also issued on 19-12-2023, in passport No.B7216079, wherein, the petitioner's date of the birth has been given as 12.09.1992. 2/6
4. According to the learned counsel for the petitioner, the said passport, dated 19-12-2023 was lost. Therefore, petitioner has filed a complaint before the concerned jurisdictional Police Station and has obtained a lost document report, dated 01.05.2025. Thereafter, she made a fresh application for reissuance of the passport on 01.05.2025. The petitioner was also called for an interview on 07.05.2025. Since the petitioner's passport has not been renewed, the petitioner has approached this Court.
5. The case of the petitioner is that her husband is employed abroad and she is residing alone in India. Due to financial constraints and the necessity to reunite with her husband and to lead a family life, the petitioner is in need of a duplicate passport. Accordingly, she applied for a fresh passport on 01.05.2025.
6. I see no impediment in directing the respondent to process the passport application filed by the petitioner on 01.05.2025. The mere fact that the date of birth in the first passport issued on 12.10.2002 was recorded as 23.08.1987, while the date of birth in the second passport issued on 19.12.2023 was recorded as 12.09.1992, cannot be a ground to reject the petitioner's request. 3/6
7. Likewise, the fact that the petitioner has changed her name to Taslim Banu Mohammed Thameem in the present application also cannot be a reason for rejection. In the application filed for re-issuance of the passport, the petitioner has mentioned her name as Taslim Banu, with the surname Mohammed Thameem, which is in consonance with the common practice of adopting the husband's name after marriage.
8. It is noticed that the petitioner would have been a minor when the first passport was issued on 12.10.2002. If the subsequent passport was issued with the correct name and correct date of birth as 12.09.1992, I find no reason why a fresh passport should not be issued pursuant to the application dated 01.05.2025.

The respondent is therefore directed to process the passport application of the petitioner dated 01.05.2025, in the usual manner, after following the necessary rules, and by ensuring that the passport issued on 19.12.2023 is duly defaced or deactivated, and thereafter, to issue a fresh passport pursuant to the said application.

10. The respondent may call upon the petitioner to furnish an affidavit explaining the reasons for the discrepancy in the date of birth, namely, 23.08.1987 as recorded in the first passport issued on 12.10.2002, and 12.09.1992 as recorded in the second passport issued on 19.12.2023.
