ORDER

Seeking to direct the 2nd and 4th respondents to initiate proceedings under Section 164 BNSS, 2023 against the 5th respondent and his men, this writ petition is filed.

2. Since no adverse order is passed against the private respondent, notice to the private respondent is dispensed with.

The learned counsel for the petitioner submitted that the 5th respondent is restraining the petitioner and his community people from participating in the temple festival, which was scheduled on 30.06.2026 and 01.07.2026 at Irulayi Amman Temple located at the outskirts of Natham Sarkar, Kanmai Karai, Pillayarkulam Group, Soorangulam, South of Sri Bandhavili Ayyanar Village Temple. Even in the previous year, when the petitioner's party was restrained 2/6

by the 5th respondent from participating in the temple festival, a similar writ petition was filed before this Court in W.P.Crl.(MD)No.1440 of 2023. This Court by order dated 19.09.2025, recording the submission made by the 4th respondent that breach of peace is apprehended, as a result of which, already the matter is recommended to Revenue Division Officer of Aruppukottai, Virudhunagar District to initiate action under Section 164 of BNSS, disposed the said writ petition. Even thereafter, during temple festival, which is ongoing yesterday and today, the petitioner and his people are prevented from participating in the temple festival. Hence, the learned counsel for the petitioner sought the indulgence of this Court to facilitate the petitioner and his people to participate in the temple festival peacefully.

The learned Government Advocate (Civil) submitted that at the fag end of the temple festival, now the petitioner has come with a surprising writ petition where he is seeking to initiate proceedings under Section 164 BNSS, which is quite not possible. She also pointed out that the representation was sent only on 29.06.2026, which was received on 30.06.2026, on which date the temple festival had commenced.

5. Heard the learned counsel on either side and carefully perused the 3/6

materials available on record.

Considering the fact that the petitioner has come before this Court in the last minute and that the petitioner and his people are prevented from participating in the temple festival, the 4th respondent police is directed to ensure that the 5th respondent is not preventing the petitioner or any person in the village community from participating in the temple festival, which is ongoing today.

7. With the above directions, this Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. 01.07.2026 NCC : Yes / No Index : Yes / No gbg Note : Issue order copy on 01.07.2026.
