PRAYER:Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to settle the difference in Grade Pay of Rs.40,800/- for 24 months (24 x 1700 = Rs. 40,800/-) as per the 12 (3) Settlement dated 04.01.2018 and as per entries made in the Service Records of the petitioner on 23.05.2018 along with belated payment interest at the rate of 6% per annum.

ORDER

The instant writ petition has been filed by a retired Checking inspector who attained superannuation on 30.04.2017. After his retirement, the management and the trade union have entered into a settlement under Section 12(3) of the Industrial Disputes Act on 04.01.2018, conferring benefits prior to his retirement.

2.Seeking the said benefits, the petitioner has sent a representation to the respondent on 08.08.2024. Since there is no response, the present writ petition has been filed.

3.Considering the above said facts, the respondents herein are directed to confer the eligible benefits upon the writ petitioner with 6% interest per annum from the due date till the date of settlement within a period of twelve weeks from the date of receipt of a copy of this order. 4.With the above said observations, this writ petition stands disposed of. No costs.
