Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the respondents to give protection to the petitioner for fencing the property in S. O R D E R

This Criminal Original Petition has been filed to direct the respondents to give protection to the petitioner for fencing the property in S.No.148/7 measuring 0.60.50 Hec (1.50 acres) Sirumaruthur Village, Devakottai Taluk, Sivagangai District.

2. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that based on a complaint lodged by the petitioner, dated 03.11.2017 the second respondent has conducted enquiry the same has been closed.

3. The instant petition has been filed in the year 2018 and now, almost one year has been lapsed and hence, due to the lapse of period, the prayer sought for by the petitioner cannot be granted now. However, the petitioner is at liberty to file a fresh petition, on fresh cause of action, if so advised.

4. With the above observations, the Criminal Original Petition is dismissed.
