ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 380 and 457 of IPC, in Crime No. 453 of 2020, seeks anticipatory bail. 2.The case of the prosecution is that on 30.12.2020 at about 12.30 am, one unidentified person trespassed into the house of the informant and is said to have snatched gold chain from the informant. Later, on seeing the foot wares of the accused, the complaint was lodged as against the accused. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate(Crl.Side) appearing for the respondent police would submit that the property is not yet recovered. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

It is the specific case of the prosecution that when the defacto complainant was sleeping in her house, the petitioner is said to have trespassed into her house and snatched the gold chain. 6.Considering the seriousness and gravity of the alleged occurrence and that the property is not yet recovered, this Court is not inclined to grant anticipatory bail to the petitioner. 7.In the result, the Criminal Original Petition is dismissed. sd/- 11/11/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
