C-41D To issue a direction directing the 1st respondent not to harass the petitioners under the guise of enquiry and pass appropriate order and thus render justice.

ORDER

Today the matter came up for hearing under the caption "For being mentioned".

2. It is brought to the knowledge of this Court that when the matter was taken up for hearing on 22.01.2026, the matter was closed with liberty to the petitioners to challenge the FIR in the

manner known to law. Later on the same day, the learned counsel for the petitioner mentioned and obtained a stay and finally the matter was disposed of with conditions. However, it was wrongly typed as "closed with liberty to the petitioners to challenge the FIR in the manner known to law". Hence, the learned counsel for the petitioner seeks necessary correction in the order dated 22.01.2026 made in Crl.O.P.(MD)No.12488 of 2025.

3. Order portion in the order dated 22.01.2026 made in Crl.O.P.(MD)No.12488 of 2025 shall be replaced by the following:

"When the matter came up for admission on 22.07.2025, it was recorded that it was unfortunate that this type of complaint had been entertained and treated as a petition enquiry from 04.07.2025, and the respondent police were directed to file a counter along with a copy of the complaint. The case was posted on 28.07.2025.

2. Further, when the matter was taken up for hearing on 25.09.2025, it was submitted that in light of the order dated 22.07.2025, an FIR had been registered, and the parties requested the Court to refer the matter to mediation for an amicable settlement. Considering the request, the matter was referred to the Mediation Centre, and further proceedings in FIR in Crime No. 925 of 2025, on the file of the Thallakulam Police Station, Madurai, were stayed. The case was adjourned to 09.10.2025.

3. This Court is of the considered view that the petitioner should be granted liberty to challenge the above said FIR. Accordingly, the petitioner is directed to take necessary steps to quash the FIR, if so advised.

4. With the above directions, this Criminal Original Petition is disposed of.

5. The order of interim stay shall remain in force till 28.04.2026. If the petitioner fails to take steps to file a petition for quashing the FIR in Crime No. 925 of 2025, the order of interim stay shall stand automatically vacated on 28.04.2026."

4. Registry is directed to carry out the necessary correction and issue fresh order copy.
