Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to forbear the respondents, their men, officials and agents from interfering with the affairs of the petitioner's club particularly the games played by its members in accordance with the objects incorporated in the Memorandum of the petitioner society.

This Writ Petition has been filed to forbear the respondents, 1/3

their men, officials and agents from interfering with the affairs of the petitioner's club.

2. The learned counsel for the petitioner submitted that he has handed over all the papers to the petitioner and he reported 'no instructions'.

3. The grievance of the petitioner is that he is the president of one M/s. Best Recreation club situated at South Chavadi Street, Boothipuram Village, Bodinayakanur Taluk, Theni District, which has been registered under the Tamil Nadu Registration Act, 1975. It was established for the purpose of development of sports activities of the students, serving to village people as well as the club members. Now the respondent police is unnecessarily interfering with the club activities. Hence, the petitioner made a representation to the respondents in this regard. Since the same has not been considered, the petitioner has filed the present petition.

Today, when the matter was taken up for hearing, the learned Government Advocate appearing for the respondents, on instructions, would submit that earlier based on the complaint given by the petitioner enquiry has been conducted, in which the petitioner himself had appeared and given a statement that the complaint has been given based on the wrong information given to the petitioner and further submitted no further enquiry is required in this petition. Recording the same, the respondent police has closed the complaint. A copy of the closure report has also been produced.

5. Considering the fact that the petitioner is not interested in proceed with the complaint, no further adjudication is required to be undertaken in this petition and accordingly, this Writ Petition is closed. No costs.
