ORDER

This petition has been filed seeking for a direction to the respondents 1 and 2 to provide adequate police protection to the life and limb of the petitioner and his family members on the basis of the petitioner's representation dated 25.06.2025.

2. The learned counsel appearing for the petitioner submitted that the petitioner's husband was working as a Principal in Tamil Nadu Polytechnic College, Madurai, and he is retired from service. The respondents 3 to 5 are neighbours, who picked up frequent quarrels against the petitioner and her family without reasonable cause. In this regard, on 24.11.2024, the petitioner lodged a complaint against the respondents 3 to 5 before the second respondent police, for which, a case and a case in counter case was registered by the respondent police as against the petitioner as well as the respondents 3 to 5.

The learned counsel appearing for the petitioner further submitted that on 03.06.2025 at about 09:15 p.m., the respondents 3 to 5, along with henchmen, unlawfully entered the petitioner's home, assaulted her and her family with wooden logs, iron rods, and sickles, by using filthy language. They damaged both the house and the vehicle before fleeing the scene. Consequently, 2/6

a case was registered against them in Crime No. 222 of 2025 on the same day. Even thereafter, the threat is still prevailing. Hence, the petitioner made a representation in this regard. However, the representation was not considered. Hence this writ petition came to be filed.

The learned Government Advocate appearing for the respondent police submitted that several FIRs have been registered as against the petitioner as well as the 3rd to 5th respondents and both the parties are trouble mongers and they are continuously indulging in unnecessary quarrels and also habitually frequenting to the police station seeking registration of FIRs as against each other. He also indicated that if this Court directs the respondent police to afford police protection to the petitioner, then the 3rd to 5th respondents may come before this Court seeking police protection for them as well.

The learned counsel appearing for the petitioner pathetically submitted before this Court that the petitioner is in a very helpless situation, where they are unable to even go to their house and they are wandering to various relatives' house for shelter, fearing the 3rd to 5th respondents. However, the petitioner's representation dated 25.06.2025 is kept in abeyance. 3/6

6. Heard the learned counsel on either sides and carefully perused the materials placed before this Court.

A careful consideration of the materials placed before this Court will prove that the police has not taken the representation made by the petitioner dated 25.06.2025 seriously, only because of the nature of the 3rd to 5th respondents, who are continuously at loggerheads without giving quietus to their enmity.

8. However, this Court is of the considered view that the enmity between the petitioner as well as the 3rd to 5th respondents should not leverage into any heinous criminal offence. In view of the same, the respondent police are directed to consider the petitioner's representation dated 25.06.2025 by putting the petitioner as well as the respondents 3 to 5 on notice under Section 64 BNSS and conduct an appropriate enquiry and shall also make it clear that neither of the party should approach the police station regarding domestic disputes or neighborhood quarrels in the future, giving quietus to the issue permanently within a period of four weeks from the date of receipt of a copy of this order.
