PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents 1 to 4 to take action against the Respondents 5 to 7 and register the complaint on the basis of the Petitioner's complaint dated 22.04.2025 within time frame that may be stipulated by this Court.

The petitioner has lodged a complaint before the respondent police and filed this petition, seeking a direction to the official respondents to take action as against the private respondents 5 to 7, by considering his complaint, dated 22.04.2025. 2/6
2.The learned counsel for the petitioner submits that the private respondents have taken idol from the Devi Temple, Srirangam, for which, the petitioner has lodged a complaint before the respondent police, however, it has not been acted upon. 3.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents submits that the subject temple is a private temple administered by one Rajamanickam Pillai. The said Rajamanickam Pillai died in the year 1974 leaving his son and 4 daughters as his legal heirs. The administration of the temple was vested with the son of Rajamanickam Pillai through a Will. Therefore, the son of Rajamanickam Pillai is administering the temple. The petitioner is the son of the third daughter of Rajamanickam Pillai. He has lodged a complaint as if the private respondents have taken away the idols from the temple. This complaint has been forwarded to the Idol Wing; they have conducted a current paper enquiry and closed the same on 15.05.2025, by referring the civil suit, which is pending 3/6
between the parties. The closure report dated 15.05.2025 is also placed before this Court.
4.This Court considered the rival submissions made and also perused the materials placed on record.
5.It appears that the petitioner has lodged a complaint that some Idols in Devi Temple, Srirangam have been stolen. Admittedly, the temple is a private temple. The complaint of the petitioner was enquired by the respondent police as current paper enquiry and it was closed as there is a dispute among the family members with regard to administration of the subject temple and civil suits are also pending before the competent civil Courts. 6.In view of the above, this Court is not inclined to entertain this writ petition. By recording the aforesaid submissions of the learned Additional Public Prosecutor, this writ petition is closed, with a direction to the respondent police to furnish a copy of 4/6
the closure report to the petitioner, enabling him to work out his remedy in the manner known to law. No costs.
