ORDER

This writ petition has been filed challenging the impugned notice in Na.Ka.No.174/2025/A1 dated 08.07.2025 issued by the second respondent

The petitioner had earlier approached this challenging the show cause notice dated 08.04.2025, issued in respect of the boundary wall sought to be put by the petitioner and in respect of construction made purportedly in the year 2013, when the petitioner was governed by the District Municipalities Act, 1920.

The petitioner had secured an order from this Court in W.P(MD)No. 12295 and 12228 of 2025, wherein a direction was issued to the petitioner to deposit a sum of Rs.2,00,000/- with the respondents within a period of four weeks from the date of receipt of a copy of the order. The petitioner however failed to deposit the amount and therefore, the petitioner filed applications for extension of time vide WMP(MD)No.8984 of 2025 and 9003 of 2025.

4. It is the case of the petitioner that, without awaiting for the orders on the applications for extension of time, the respondents have issued the impugned 2/5

communication on 08.07.2025. It is further submitted that the construction was made under the erstwhile District Municipalities Act, 1920. It is submitted that it cannot be touched upon unless the proceedings are pending under the provisions of Tamil Nadu Urban Local Bodies Act, 1998.

5. This Court is not inclined to entertain this writ petition, as the petitioner has already approached the Division Bench of this Court in W.P(MD)No.12295 and 12228 of 2025. It is said that writ petitions are still pending before the Division Bench of this Court.

6. In view of the above, the writ petition is liable to be dismissed and is accordingly, dismissed with liberty to the petitioner to approach the Division bench of this Court for appropriate relief. No costs. Consequently, the connected miscellaneous petition is closed.
