2. The petitioner applied for issuance of passport. Since the petitioner is facing criminal case, the second respondent did not issue clearance certificate. It is seen that Crime No.100 of 2019 registered against the petitioner under Sections 279 and 337 IPC is still pending at FIR stage. This cannot operate as an impediment. Therefore, the first respondent shall process the petition-mentioned application and issue passport to the petitioner subject to fulfillment of the other usual formalities. This writ petition stands allowed. No costs.
