Prayer : Criminal Original Petition filed under Section 528 of BNSS, to accept the surrender of the petitioner before the Special Court of S.C./S.T. (Prevention of Atrocities) Act i.e. the 1st Additional District and Sessions Judge at Thanjavur in connection with the Cr.No.169 of 2025 on the file of the 2nd respondent police and to consider the bail application filed by the petitioner on the same day. 1/4

O R D E R

Seeking direction to the learned Special Court of S.C./S.T. (Prevention of Atrocities) Act /I Additional District and Sessions Judge at Thanjavur, to consider the bail application to be filed by the petitioner, on the same day on his surrender in connection with Crime No.169 of 2025, on the file of the second respondent, the petitioner has approached this Court.

2.The allegation as against this petitioner and other accused is that they set fire in the dwelling house of the defacto complainant and also abused him by degrading his caste name. Therefore, the case in Crime No.169 of 2025 has been registered as against this petitioner along with other accused, for the offence under Sections 296(b), 303(2), 332(c), 351(3) of BNS, 2023 r/w 3(1)(r), 3(1)(s), 3(2)(iii) of SC/ST (POA) Act, 1989.

3.Mr.P.Kottai Chamy, learned Government Advocate (Crl.side), who takes notice for the respondents submits that the accused 1 to 3 have been arrested and they are still in custody. The petitioner before this Court is A4.

4.Considering the nature of offence, this Court is not inclined to entertain this petition. Accordingly, this Criminal Original Petition is dismissed.
