ORDER

The petitioners are the accused persons in Crime No.285 of 2025 on the file of the 2nd respondent Police. The said case was registered for the offences under Sections 191(2), 296(b), 115(2), 118(1), 351(3) of BNS Act, 2023 and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of SC/ST (POA) Amendment Act, 2015. Therefore, the petitioners have filed this petition seeking a direction to the learned Principal and District Sessions Judge (Special Court) for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (amended) 2015, Theni, to consider their bail application on the same day of their surrender.

2. The case of the prosecution is that the third respondent had married one Abirami. The first petitioner had sent a message to the said Abirami through instagram and the above said act of the first petitioner was questioned by the third respondent. Further, on 03.07.2025, there was a wordy quarrel between the first petitioner and the third respondent and at 2/5

that time, the petitioners and others attacked the defacto complainant and scolded him in filthy language and threatened him with dire consequences. Hence, the complaint.

3. When this petition is taken up for consideration, the learned Government Advocate (Crl. Side) submits that the first petitioner had sent a message to the defacto complainant's wife and when the same was questioned by the defacto complainant, the petitioners and others attacked him. Hence, he raised his objections to allow this petition.

4. Considering the act of the petitioners that first petitioner sent messages to the defacto complainant's wife, this Court is not inclined to entertain this petition. However, it is open to the petitioners to surrender before the concerned Court and seek bail. Accordingly, this Criminal Original Petition is dismissed.
