ORDER
Challenging the order passed by the learned Judicial Magistrate, Keeranur, in Crl.M.P. No.243 of 2025 dated 07.07.2025, whereby the petition filed by the petitioner under Section 497 of the BNSS seeking return of the RC book of the vehicle bearing registration number TN 55 BV 8974 was dismissed. Since the said vehicle was involved in an offense under Mines & Minerals (Development & Regulation) Act, the claim of the petitioner was rejected. Challenging the same, this criminal revision case is filed.
2. The said RC book was submitted by the petitioner at the time of taking interim custody of the said vehicle and now he sought for returning the same for the purpose of getting Fitness Certificate to the said vehicle. However, the learned Judicial Magistrate had dismissed his application.
3. Considering the limited scope of the relief sought for, this Court setting aside the impugned order, dated 07.07.2025 in Crl.M.P.No.243 of 2/4
2025 and directs the learned Judicial Magistrate, Keeranur to hand over the RC book of the Ashok Leyland Dost vehicle bearing registration number TN 55 BV 8974 as an interim measure for a period of one month to the petitioner and the petitioner on receipt of the same, shall produce the same before the Regional Transport Officer for getting Fitness Certificate and on completion of that process, should surrender the RC book back to the Judicial Magistrate within a period of thirty (30) days from the date of receipt of the RC book from the Judicial Magistrate. The petitioner is also directed to file an affidavit undertaking that he would return the RC book within a period of thirty (30) days before the learned Judicial Magistrate, Keeranur.
