Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents more particularly the 1st respondent to issue fresh passport to the petitioner based on petitioners application dated 18.09.2024 pending in File No. MD1066977752724 within a time frame.

ORDER
This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Central Government Standing Counsel appearing on behalf of the first respondent and the learned Government Advocate appearing on behalf of the second respondent.
2. The petitioner has approached this Court seeking Writ of Mandamus to the respondent No.1 to issue fresh passport to the petitioner based on petitioner's application, dated 18.09.2024.
3. The petitioner is 19th accused in Crime No.179 of 2021, dated 03.06.2021 on the file of the second respondent Police Station for the offences punishable under Sections 143, 147, 148, 294(b), 353, 332 and 506(ii) of IPC.
4. It is confirmed by the learned counsel for the second respondent that pursuant to the FIR registered in Crime No.179 of 2021, charge sheet has been filed against the petitioner as early as on 21.07.2025 through online, however it has not been taken on file by the concerned Court. 2/4

Having considered the submissions made by the learned counsel for the petitioner and the learned counsel for the respondents and I am of the view that there can be no impediment for directing the first respondent to issue a fresh passport to the petitioner by processing the passport application of the petitioner, dated 18.09.2024.
6. Accordingly, the first respondent is directed to issue a fresh passport to the petitioner. In case charge sheet filed by the second respondent before the concerned Court is taken on record by the concerned Court, the passport which is to be issued to the petitioner shall be surrendered to the learned Judicial Magistrate, Kadaladi, Ramanathapuram District. It is made clear that the petitioner shall not travel outside the country without permission of the aforesaid Court, if Charge Sheet filed before the concerned Court is taken on record.
