ORDER
This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Government Advocates for the respondents.
2. This Writ Petition has been filed for interim custody of the petitioner's vehicle bearing Registration No.TN-49-AM-9495, which was seized in connection with FIR No.85 of 2025 on the file of the 2nd respondent Police.
3. The learned Government Advocate for the second respondent would submit that although the petitioner's vehicle was involved in the aforesaid crime and First Information Report has been registered in Crime No.85 of 2025, on 12.04.2025 for the offences punishable under Section 4 of TN Essential Trade Articles (Regulation of Trade) Order, 1984 and Section 7(i)(a)(ii) TN Essential Commodities Act, 1955, it is informed that no proceedings have been initiated to confiscate the said vehicle, which was seized on 12.04.2025. 2/4

Considering the submission made by the learned Government Advocate, there shall be a direction to the second respondent to release the petitioner's vehicle bearing Registration No. TN-49-AM-9495, subject to the petitioner furnishing appropriate security as may be required. Such release shall be without prejudice to the rights of the respondents to initiate penalty proceedings and to order confiscation under Section 6(A) of the Essential Commodities Act, 1955, if warranted.
