For Petitioners : Mr.S.Prabhu For Respondents : Mr.T.Vadivelan O RDER This petition is filed seeking to quash the private compliant in STC No.567 of 2022 on the file of Judicial Magistrate Court, Thirumangalam. 2.Repeatedly the case has been adjourned. The learned counsel for the petitioner wants the Court on the last occasion to refer the matter to 1/4
the Mediation Centre. At the time of referring the matter to Mediation Centre, undertaking of compromise was made by the learned counsel for the petitioner that he will certainly settle the issue before the Mediation Centre. Only on that ground the matter was referred to the Mediation Centre. But later informed the Court that there was no settlement between the parties. Now, the learned counsel for the respondent would submit that the petition has been filed to drag on the proceedings, since on the basis of the undertaking given by the petitioner the matter was referred to the Mediation Centre and now it is not settled. Even today, the learned counsel for the petitioner is not ready to argue the matter. He seeks further time for arguments. This Court is not inclined to adjourn the matter further. This petition is liable to be dismissed for non prosecution. 3.Accordingly, this criminal original petition is dismissed for non prosecution. Consequently, connected miscellaneous petitions are closed.
