O R D E R

This petition has been filed to direct the second respondent or any other competent police officer to conduct further investigation in the case in Crime No.29 of 2017 on the file of the second respondent police.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor has produced the entire CD files. On a perusal of the same, it is seen that investigation has been undertaken and on 15.04.2021, the enquiry has been closed as 'mistake of fact' and referred charge sheet notice has also been served upon the petitioner.

3. The learned counsel for the petitioner submits that referred charge sheet notice has not been served upon the petitioner as stated by the learned Additional Public Prosecutor.

4. The learned Additional Public Prosecutor is directed to serve the referred charge sheet notice to the petitioner. After obtaining referred charge sheet notice, the petitioner is at liberty to work out his remedy by filing appropriate proceedings before the appropriate court.
