ORDER

After some arguments, learned counsel for writ petitioners seeks permission to withdraw the writ petition, but makes a plea that the rights of writ petitioners may please be preserved for filing a fresh writ petition on the same cause of action inter alia by annexing a copy of the plaint in O.S.No.1142 of 2018 on the file of the learned District Munsif, Trichy.

2.To be noted, it is not in dispute that the writ petitioners are defendants in the said suit and the said suit has been cited as primary reason for making the impugned order. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.[MD]No.21131 of 2019 3.Permitted to withdraw preserving the rights of the writ petitioners to file a fresh writ petition on the same cause of action.

4.Instant Writ Petition is dismissed as withdrawn albeit preserving the rights of the writ petitioner in the aforesaid manner. No costs. Consequently, connected Miscellaneous Petition is closed.
