ORDER : The Court made the following order :- The petitioner, who is apprehending arrest at the hands of the respondent police for the offences punishable under section 6(4) of Tamil Nadu Scheduled 1/3
Commodities (Regulation of Distribution by Card System) order, 1982 r/w section 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.108 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 22.07.2023, at about 01.00 hours, when the respondent police team were on routine check up, they found that the accused persons illegally transported 9700 Kgs of PDS rice. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent persons and he has been falsely implicated in this case. He further submitted that the petitioner is only the friend of the co-accused and other than that he has not committed any offence as alleged by the prosecution.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that huge quantity of PDS rice was recovered from the petitioner and on enquiry, it reveals that the petitioner along with the other accused collected PDS rice from card holders and also sold the same to the other people. Therefore, the custodial interrogation of the petitioner is very much necessary in this case. 2/3
5.Considering conduct of the petitioner and also the fact that PDS rice is used by the poor people and the said offence will amount to an offence against the poor man's economy, this Court is not inclined to grant anticipatory bail to the petitioner.
