PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified mandamus to call for the records pertaining to the impugned notice in Letter Ref. No. SCN/1049175344/25 dated 21.05.2025 passed by the Respondent No.1 and quash the same as illegal, consequently directing the Respondent No.1 to renew the passport to the petitioner forthwith based on his application in File No.MD1075048564225 dated 19.05.2025. 1/5

ORDER
The present writ petition has been filed seeking to quash a notice issued by the first respondent on 21.05.2025 wherein the petitioner has been directed to appear in person along with the passport.
2. According to the learned Central Government Standing counsel appearing for the first respondent, the petitioner is holding two passports and therefore, he has been directed to appear in person.
3. The learned Government Advocate(crl.side) appearing for the second and third respondent submits that the petitioner has been charge sheeted in a criminal case in S.T.C.No.962 of 2022 on the file of the learned Judicial Magistrate, Paramakudi. A charge sheet has been laid on 16.12.2024. 2/5

As far as the prayer seeking to quash the notice issued by the first respondent is concerned, it is for the petitioner to appear before the first respondent and explain the circumstances under which he is holding two passports. Therefore, this Court is not inclined to quash the show cause notice. As far as the request of the petitioner for renewal of the passport is concerned, the petitioner is directed to approach the trial Court concerned and seek the permission of the Court to go abroad. Based upon the order to be passed by the trial Court concerned and a decision to be taken by the first respondent pursuant to the show cause notice, issuance of the passport could be considered.
5. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 09.12.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/5
