PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to take necessary action on the basis of the petitioner's representation dated 08.08.2022 with regard to provide alternative employment as light duty in terms of Section 47(1) of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participations) Act, 1955 and consequently direct the respondents to pay wages and all other attendant benefits for the period within the time limit that may be fixed by this Court.

O R D E R

The primary grievance of the petitioner in this Writ Petition is that he has not been afforded alternate employment. However, it is now brought to the notice of this Court by the learned Standing Counsel appearing for the respondents that subsequent to the filing of this Writ Petition, the petitioner has been granted alternate employment from 18.09.2022 onwards. The said fact is also not disputed by the learned Counsel for the petitioner. However, she 2/4

would submit that the wages of the petitioner has not been paid from 25.07.2022 to 17.09.2022.

2.No prejudice will be caused to the respondents if a direction is issued to them to consider the grievance of the petitioner with regard to non-payment of wages for the aforesaid period on merits and in accordance with law within a time frame to be fixed by this Court.

3.Since the primary grievance of the petitioner namely affording alternate employment has been redressed, this Writ Petition is disposed of, by directing the respondents to consider the further representation of the petitioner with regard to non-payment of wages to the petitioner for the period from 25.07.2022 to 17.09.2022, on merits and in accordance with law and pass final orders within a period of twelve [12] weeks from the date of receipt of a copy of this order.
