(Amended as per order of this Court dt 11/1/2022 in Crl.MP(MD) No.367/2022 in Crl.OP(MD) No.17206/2021) ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police, for the offences punishable under Sections 406, 417 and 376(i) of IPC, in Crime No.27 of 2021, seeks anticipatory bail.
2.When the matter is taken up for hearing, the learned Government Advocate(Crl.Side) submitted that based upon the complaint given by the defacto complainant, enquiry was undertaken https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.17206 of 2021 and during the course of enquiry, the petitioner made an undertaken that he will appear before the respondent police for enquiry. Thereafter, he did not appear before the respondent police and filed this petition seeking anticipatory bail.
3. The learned counsel for the petitioner submitted that after six months from the date of occurrence, the present complaint has been given by the defacto complainant.
4.On perusal of CD file, shows that the petitioner and the defacto complainant fell in love with each other for the past two years and on the false promise of marriage, the petitioner committed sexual intercourse with defacto complainant and thereafter, he refused to marry her.
5. Considering the conduct and attitude of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioners.
