ORDER

(Order of the Court was made by M.S.Ramesh J.) The petitioner, who is a third party to the writ proceedings, had filed the present application for permission of this Court to accept the cause title.

2. It is brought to our notice that at the time of numbering this application, he had made an endorsement in Page No.9 of the typed set of papers that he is not pressing the present application. However, the Registry by inadvertence had numbered the application as CMP(MD) No.15017/2024 and had listed before the earlier Coordinate Bench of this Court. Since it was not brought to the notice of this Court about the endorsement made by the petitioner herein, the Miscellaneous Petition came to be ordered as prayed for on 28.10.2024.

3. When this mistake was thereafter realized by the Registry and brought to our notice, we had directed the present Miscellaneous Petition to be listed today under the caption, 'for being mentioned'.

4. The learned counsel for the petitioner ratifies that he had made an endorsement in the present application that he is not pressing the same. Since the Coordinate Bench was not apprised of this fact, we deem it appropriate that earlier orders, allowing this application, may be recalled. Accordingly, the order passed in CMP(MD) No.15017/2024 in WA(MD) No.SR60657/2024 dated 28.10.2024 allowing the Miscellaneous Petition is recalled. However, in view of the endorsement made by the learned counsel for the petitioner/ appellant, the present Miscellaneous Petition stands dismissed as not pressed.
